Terms of Service

By accessing or using Boba ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, candidates, recruiters, and visitors.

Boba is a talent sourcing platform that connects active job seekers ("Candidates") with recruiters and hiring managers ("Recruiters"). Candidates create searchable profiles; Recruiters pay a subscription to search those profiles and spend contact credits to unlock contact information.

Boba is not a job board. We do not post job listings, process applications, or facilitate employment contracts. We provide a discovery and contact layer only.

As a Candidate, you agree to:

• Provide accurate, current, and complete information in your profile
• Keep your profile up to date, particularly your availability status
• Not impersonate another person or misrepresent your credentials
• Not use the platform to spam recruiters or send unsolicited messages
• Not create multiple accounts for the same person

Candidate accounts are free. You grant Boba a non-exclusive, worldwide license to display your profile to Recruiter subscribers for the purpose of talent discovery.

As a Recruiter, you agree to:

• Use candidate contact information only for legitimate hiring and recruitment purposes
• Not resell, redistribute, or share unlocked candidate contact details with third parties
• Not scrape, export in bulk, or systematically extract the candidate database
• Not use the platform to send spam, phishing, or fraudulent messages to candidates
• Comply with applicable employment and anti-discrimination laws in your jurisdiction

Subscriptions are billed monthly. Contact credits reset on your billing date and do not roll over. Refunds are not issued for unused credits or partial billing periods unless required by applicable law.

• Each credit unlocks one candidate's contact information (email and/or phone)
• Unlocked candidates are saved to your account, re-viewing does not consume an additional credit
• Credits reset monthly on your billing renewal date
• Enterprise plan subscribers have unlimited contact unlocks
• Credits have no cash value and cannot be transferred between accounts

You may not use Boba to:

• Violate any applicable law or regulation
• Harass, threaten, or harm any user
• Post false, misleading, or defamatory content
• Interfere with the platform's infrastructure or security
• Circumvent any access controls or subscription gates
• Collect or harvest user data through automated means
• Use AI or automated tools to mass-contact candidates outside of normal platform flows

Boba and its content (excluding user-submitted profiles) are owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our written consent.

You retain ownership of the content you submit (your profile, resume, etc.). By submitting it, you grant us the rights described in these Terms.

We reserve the right to suspend or terminate any account that violates these Terms, engages in harmful behavior, or is used fraudulently, without prior notice. Candidates can delete their account at any time. Recruiter subscriptions can be canceled through the billing portal, with access continuing until the end of the current billing period.

Boba is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that any particular job outcome will result from using the platform. We make no representations about the accuracy or completeness of candidate profiles.

To the maximum extent permitted by law, Boba and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

These Terms are governed by the laws of the jurisdiction in which Boba is incorporated. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the platform after changes constitutes acceptance. If you disagree with updated terms, you may close your account.
